Under threat of termination and losing his retirement pension, Perry entered into a settlement agreement with Census. As the contract stated, Perry had to retire voluntarily by September 4, 2012. Discrimination claims against the agency had to be dropped. Census Acting Director of Human Resources Ted Johnson (and others) ratified the agreement. Johnson, who had a history of discrimination complaints filed against him, signed Perry's settlement agreement on August 11, 2011. Perry signed August 16, 2011.
